Notice of Intent to Request Release of Funds for Property Demolition

On or about March 17, 2026, the City of Pottsville will authorize the Pottsville Housing Authority (PHA) to submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Public Housing Capital Fund Program funds authorized under Section 9 of the United States Housing Act of 1937 (42 U.S.C. 1437g), as amended, to undertake a project known as 646 N 2nd St Disposition and/or Demolition for the purpose of disposition and/or demolition of the single-family residential structure located at 646 N 2nd St in Pottsville, PA. The Pottsville Housing Authority wishes to dispose of the vacant, condemned property to a buyer. If the sale falls through, the authority will demolish the structure. Demolition materials would be disposed of following state and federal regulations at a C& D landfill. Clean fill would be utilized for site restoration. There would be no immediate plan for reuse following demolition. Estimated CFP Funds: FY 2024 - $25,000; FY 2025 - $25,000. Total estimated project cost $50,000.

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Pottsville Housing Authority, 410 Laurel Blvd, Pottsville, PA 17901, and may be examined or copied weekdays between 9:00 A.M. and 4:00 P.M.

Any individual, group or agency may submit written comments on the ERR to Jody Dunnigan, Deputy Director, Pottsville Housing Authority, 410 Laurel Boulevard, Pottsville, PA 17901 or by email to [email protected] . All comments received by March 16, 2026, will be considered by the City prior to authorizing the submission of a request for release of funds.

The City of Pottsville certifies to HUD that Thomas B. Smith, Certifying Officer, in his capacity as Mayor of the City of Pottsville consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Pottsville Housing Authority to use Capital Fund Program funds.

HUD will accept objections to its release of funds and the City of Pottsville's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:

• the certification was not executed by the Certifying Officer of the City of Pottsville;

• the City of Pottsville has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58;

• the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or

• another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

Objections must be prepared and submitted via email or mail in accordance with the required procedures (24 CFR Part 58, Sec. 58.76), and shall be addressed to HUD-PIH, Philadelphia Field Office, [email protected] , Director, Office of Public Housing, US Department of Housing and Urban Development, 801 Market Street, Strawbridge's Building, Philadelphia PA 19107. Potential objectors should contact the Director of Public Housing via email to verify the actual last day of the objection period.
